Mileage Buyout

CRC staff who are covered by the National Agreement  who transferred to the Probation Service on 26th June 2021 may be eligible for a buy-out as per point 6.8 of the National Agreement.

The buyouts available are as follows:

  • If, on transfer you are in a post designated as attracting essential car user status (with no end date) – you will receive a one-off compensation payment of £1,000.
  • If you are currently eligible to claim mileage at the casual user rate of 65p per mile and have claimed a minimum of 350 miles in the past 12 months – you will receive a one-off compensation payment of £410; or,
  • If you are currently eligible to claim mileage at the casual user rate of 52p per mile up to and including 64p per mile, and have claimed a minimum of 350 miles in the past 12 months – you will receive a one-off compensation payment of £150.

We will use data from current employers to identify those who are eligible

We will work out whether you meet any of the above criteria using data that your current employer organisation has returned to us with your mileage claims and whether you attract essential car user status.

If we do not receive a full 12 month’s return from your CRC organisation, we will work out an average per month to create a 12 month value, for example, if we have 9 months’ worth of data indicating you had claimed 320 miles at 55p per mile, then we will divide 320 by 9, and multiple it by 12 to create 12 month value of 426.7 miles.

When the payment will be made:

The compensation payment will be made in July’s payroll and appear on your payslip in July. If you do not receive a compensation payment on 30th July and believe you are entitled to a compensation payment, then you will be able to submit an appeal to be considered for a mileage buy-out.

The appeals process for mileage buy-out opens on 1st August 2021 and closes on 20th August 2021. Any appeals received after 20th August 2021 will not be considered.

Appeals guidance and forms will be posted on the Welcome Hub on 30th July 2021. 

Appeals will be heard over August/September, and any successful appeals will be paid compensation payments.

Appeals can be submitted on an appeals form, which you can find at the bottom of this page, and should submitted along with appropriate supporting evidence.

Supporting evidence can include claim history, example claims highlighting the rate, travel plan, work schedule showing journeys with line manager endorsement,  P11D benefits in kind return, expenses report, CRC pay slips, contract of employment, formal statement by line manager endorsed by Head of PDU).

Appeals forms and supporting evidence must be sent to ProbationHQHR@justice.gov.uk by 20th August 2021. No late returns will be processed.

The appeals process will represent the final opportunity for you to claim for the compensation payments. Should an appeal be rejected by the panel then there is no other course of action.

The following are the only grounds for appeal against a decision to not award a mileage allowance buy-out:

  • Factually incorrect information was used in the calculation of the buy-out
  • Employee provides new information which would affect the buy-out
  • The employee was unable to achieve the 350 miles claimed in the last 12 months threshold on account of covid19 work/travel restrictions and / or long-term absence from the workplace
  • The employee can evidence that he/she was contractually entitled to an essential car user allowance if this is disputed
